Electronic Data Transfer (EDT) Pilot Program

 

Why is there an EDT Pilot Program?

Based upon statute, the California Integrated Waste Management Board (CIWMB) may allow businesses that must manifest waste tires to submit an electronic report in lieu of a paper manifest (California Public Resources Code, Section 42961.5 (f) (1)). Based upon information gathered in public workshops, on-site visits, and other communications with industry members, the Board is implementing a pilot program allowing electronic data transfer of manifest data. Because tire haulers have been involved in all aspects of waste tire manifesting and the recent changes in waste tire manifesting will include a large number of new business entities, the pilot program will initially be restricted to a very small number of tire haulers who handle large volumes of transactions and have demonstrated sufficient technical capability to participate in the pilot.

The goal of the pilot program is to determine whether electronic submission of tire manifest information will allow tire haulers to more easily meet their statutory reporting requirements while reducing the state’s costs for form printing and processing. Board staff currently believes it is highly likely these goals will be achieved by this pilot program and anticipate the program being permanently adopted in the future.

What does EDT do?

EDT allows a waste tire hauler to submit data electronically that they would otherwise have to submit via official CIWMB paper logs and manifests. The tire hauler can submit an electronic record for each waste tire pickup/delivery using an electronic file format specified by the Board. The tire hauler can submit some or all of their data via EDT, although in a few specific cases they will have to complete and submit official paper manifest forms (e.g., customer wants an official CIWMB manifest form completed). Program participants will submit data electronically to the Board via a secure Internet site using a pre-arranged username and password. If the hauler’s waste tire generator/end use facility customer agrees, a tire hauler can submit their customers’ manifest data to the Board in place of the customer mailing documents to the Board.

Pilot Project Participants

CIWMB will initiate an EDT pilot project with a limited number of organizations. During the initial phase, only hauler organizations will participate in the pilot project and submit waste tire manifest system data electronically since haulers are involved in all aspects of transporting waste tires (as opposed to generators and end-use facilities).

The two hauler businesses that have been approved by CIWMB to participate in the pilot project are:

  • Golden By-Products Ballico, CA
  • Lakin Tire West, Inc. Santa Fe Springs, CA

Operation and Advantages

During the EDT pilot project, Golden By-Products and Lakin Tire West, Inc. will collect waste tire manifest information for all waste tire transactions on behalf of the generators and end use facilities with whom they do business. This data will be electronically transmitted to CIWMB in Sacramento and will be considered valid business data as if it came from a waste tire manifest system forms submitted by the generators or end use facilities. During the pilot project, participation by generators and end use facilities is optional and they may still opt to complete the actual waste tire manifest system forms.

An advantage of electronic data transmittal is that it enables hauler businesses to retain current business practices and forms with minimal modification to support the electronic data transmittal requirements. In most cases, the participants in EDT pilot project (as well as other haulers) are already collecting much of the same information as is contained on the waste tire manifest form—business name, address, tire and load types, and load amount. Another advantage is that the generators and end use facilities will have minimal paperwork to complete and in most cases will be performing the same transaction procedures as before.

Haulers must maintain and keep with them, a letter from CIWMB authorizing their participation in the EDT program, and present this authorization letter to law enforcement, generators, and end use facilities as requested.

Participation by haulers in the EDT pilot project is voluntary and may be cancelled by the hauler or the State of California/CIWMB with 30 days written notice. If a hauler’s participation in the pilot project is cancelled, CIWMB will notify, in writing, all generators and end use facility operators doing business with the hauler of this change and the need for them to begin using the paper waste tire manifest forms. Similarly, generators and end use facilities may, at any time, opt out of the electronic data pilot project with the respective EDT pilot project hauler. If this occurs, the generators or end use facilities will begin using the paper waste tire manifest forms for all waste tire transactions.
