On October 10, 1999, Governor Gray Davis signed into law AB 75, which requires State agencies and large State facilities to divert at least 25 percent of their solid waste from landfill disposal or transformation facilities by January 1, 2002, and at least 50 percent by January 1, 2004. Diversion is the process of reducing potential waste by means such as source reduction (reducing or eliminating the amount of materials used for any purpose before they become waste), recycling, and composting.

The law defines State agency as every State office, department, division, board, commission, or other agency of the State. A large State facility is defined as those campuses of the California State University, the California Community Colleges, prisons within the Department of Corrections, facilities of the State Department of Transportation, and facilities of other State agencies that the California Integrated Waste Management Board (CIWMB) has determined are primary campuses, prisons, or facilities.

Under the law, each State agency and large State facility must adopt and submit an integrated waste management plan (IWMP) to the CIWMB, which outlines the steps to be taken to achieve the mandated waste diversion goals. The Board’s implementation of AB 75 provides two planning options: submission of a full plan or a modified plan.

The law also requires State agencies and large State facilities to submit annual reports to CIWMB regarding solid waste reduction beginning April 2002.

Full Plan

Each State agency—except those eligible to submit a modified plan—and every large State facility must adopt and submit a four-part integrated waste management plan as described below. Each State agency should aggregate data for all its applicable facilities, excluding large State facilities. Each large State facility must submit a site- or district-specific plan.

Part I—State Agency Information Form

All State agencies and large State facilities must submit this completed form which includes the organization's full name, headquarters location, and director’s name, as well as the designated recycling coordinator’s name, location, contact number, e-mail address, and the number of employees.

Part II—State Agency List of Facilities

All State agencies and large State facilities must provide information on all their facilities using this form, including the name and physical address of each facility; a contact person’s name, phone number, and e-mail address; and the number of employees at the specific site or facility.

Part III—State Agency Waste Reduction and Recycling Program Worksheet

Part III of the waste management plan is broken down into three parts: Diversion, Promotion, and Procurement. The diversion portion is made up of the program summary and the program details. The program summary lists the total tonnage diverted, tonnage disposed, tonnage generated, and the overall diversion percentages.

Column C is the amount of material anticipated to be diverted for every existing program activity at the State agency. Columns D, F, H, J, L, N are estimates of proposed diversion tonnage to help State agencies focus on the programs that will achieve the greatest amount of diversion, while using the least amount of energy and resources. Achieving the 50 percent diversion goal, therefore, becomes more readily attainable.

It is important to complete the proposed diversion tonnage through the calendar year 2006 to show which programs the State agency will emphasize to meet the waste diversion goals of 25 percent by 2002 and 50 percent by 2004.

Diversion—This section outlines existing programs and planned programs within the plan and includes Source Reduction, Recycling, Composting, and Special Waste areas. Estimated tonnages have been developed to show how an agency or facility plans to achieve the 50 percent diversion mandate. As the annual report periods pass, actual diversion and disposal numbers will be posted showing the progress toward achieving the 50 percent diversion by 2004 and beyond.

Promotion—This section involves all of the promotional programs used by the agency to inform their employees and customers about their diversion programs. No specific measurement of success is measured. An “x” in a specific area means that either the program exists or is planned for the future.

Procurement—Included in this section are all the programs adopted by the State agency for the State Agency Buy Recycled Campaign (SABRC). No specific measurement or documentation is provided here. The CIWMB operates the SABRC program, which receives yearly reports, monitors, and measures the impact and success of State agencies' recycled-content purchases. Please contact SABRC for specific information and details.

Part IV—State Agency Integrated Waste Management Plan Questions

In this narrative portion of the plan, State agencies and large State facilities provide information regarding their mission, specific policies, a description of their waste stream, and their existing diversion programs. Reporting agencies and facilities are requested to keep their responses short and concise. State agencies submitting a modified plan must complete questions 1, 5, 6, and 7. The information contained in this area represents all the information submitted by the reporting entity; CIWMB does not edit the plans unless requested.

Modified Plan

A State agency may submit a modified IWMP if it has fewer than 200 total employees and annually generates less than 100 total tons of waste statewide. State agencies meeting this criteria must complete and submit the following portions of the full plan as described above: Part I—State Agency Information Form; Part II—State Agency List of Facilities; and Part IV—questions 1, 5, 6, and 7. The CIWMB will review the modified plan to determine compliance. Eligibility to submit a modified plan must be established for each annual reporting period.
