The Board developed the Five-Year CIWMP/RAIWMP Review Report template (MS Word, 518 KB) to provide a cost-effective tool to assist counties and regional agencies analyze the adequacy of their planning documents, and to complete and submit the Five-Year CIWMP or RAIWMP Review Report to the Board. The following describes each section of the Five-Year CIWMP or RAIWMP Review Report template and provides general guidelines with respect to preparing the report. If you have any questions regarding completing the Five-Year CIWMP or RAIWMP Review Report, please contact your Local Assistance & Market Development staff representative at (916) 341-6199 for assistance. Section 1.0—County or Regional Agency InformationProvide contact information for the county or regional agency submitting the Five-Year CIWMP or RAIWMP Review Report. Prior to submitting the report, please ensure that the authorized signature is provided. Section 2.0—BackgroundProvide basic background information regarding the planning documents for the county or regional agency (the affected jurisdictions, diversion requirements, etc.). There is also an area for additional information (recent regional agency formation, newly incorporated city(s), etc.). Section 3.0—Local Task Force ReviewThe information requested in this section demonstrates compliance with the LTF review and comment requirements of Title 14, CCR 18788. The requested information includes the LTF membership, an overview of the LTF comments (provide summary or cite pages in an attachment, if included), and the date LTF comments were submitted to the county or regional agency and to the Board. Section 4.0—Title 14, California Code of Regulations, section 18788 (3)(A) through (H)Nothing in statute or regulations specifies what kind or size of change would trigger the need for a plan revision—either as a result of a county’s or regional agency’s analysis, or the Board’s. Title 14, CCR section 18788 does, however, specify certain topic areas that should be addressed in a Five-Year CIWMP or RAIWMP Review Report. The Five-Year CIWMP or RAIWMP Review Report template provides a subsection to address each of these content requirements and to document changes that may have occurred since the preparation and approval of the CIWMP or RAIWMP. The analysis in this section should specifically address whether these or other changes warrant a revision to one or more of the planning documents, or if updates to the elements (via Annual Reports, a new or corrected SWGS, Time Extension, etc.) sufficiently address any effects these changes have on the county’s or regional agency’s management of solid waste. Additionally, the analysis should include the basis for this determination. The following outlines the Five-Year CIWMP or RAIWMP Review Report content requirements of Title 14, CCR section 18788 and also provides some useful tools for the LTF's and county's or regional agency's evaluation and analysis. Note: Please be sure to include all available data up to the year the 5-Year CIWMP or RAIWMP Review Report is prepared. For example, if a county or regional agency's first Five-Year CIWMP or RAIWMP Review Report is being submitted to the Board in 2008, please be sure to include all available data up to 2004, which would be up to and including 2006 for most data sets. Continuing with that example, in subsequent 5-Year CIWMP or RAIWMP Review Reports, the baseline data should remain the same as in the previous report. Only the reporting year information will change; and again it should include the most current data at the time the report is prepared. In this section, you are evaluating changes in these data between the baseline and the report year as they relate to planning document adequacy. Section 4.1 Changes in demographics in the county or regional agency.The following sources provide data that can be used to evaluate countywide and regional demographic changes. Section 4.2 Changes in Quantities of Waste within the County or Regional Agency; and Changes in Permitted Disposal Capacity and Waste Disposed in the County or Regional Agency.Tools to analyze changes in the waste stream are available from the following sources. Section 4.3 Changes in funding sources for administration of the Countywide Siting Element (SE) and Summary (SP).Section 4.4 Changes in administrative responsibilities.Section 4.5 Programs that were scheduled to be implemented but were not.Regulations provide that the analysis for such a change must include: The Board’s Planning Annual Report Information System (PARIS) Jurisdiction Diversion Program List details information on the status (progress) of all jurisdiction diversion programs that are planned, operating, or dropped. PARIS data also includes the reason that selected programs were not implemented. Section 4.6 Changes in available markets for recyclable materials.The Recycling Market Development Zone program is a partnership of local governments and the Board, created to provide incentives to businesses that use secondary materials from the waste stream as feedstock for their manufacturing processes. Section 4.7 Changes in the implementation schedule.Note: Any of the changes in sections 4.1 through 4.7 should be reported for each jurisdiction in the county or regional agency with an explanation as to whether the change necessitates a revision to any of the jurisdictions’ planning documents. Section 5.0—Other IssuesIf applicable, the Five-Year Review CIWMP or RAIWMP Report should also include analysis regarding any other significant issues or changes and a determination as to whether these issues/changes affect the adequacy of the CIWMP or RAIWMP such that a revision to one or more of the planning documents is needed. Section 6.0—Annual Report ReviewThe analysis in this section should address whether any of the jurisdictions documented in their Annual Report the need to revise one or more of their planning documents and whether the county or regional agency concurs with that determination. For example, a jurisdiction may report in its Annual Report that one or more of its planning documents need to be revised. The county or regional agency, however, may determine that this information is sufficiently addressed via an update to the diversion program implementation information in the jurisdiction’s Annual Report (Section C) making a revision unnecessary. If the county or regional agency is uncertain as to whether a particular change or circumstance necessitates a revision to one or more of the elements or plan comprising the CIWMP or RAIWMP, please contact your local assistance staff representative to discuss the matter further. Additionally, to request a report of the Electronic Annual Report data relating to the CIWMP or RAIWMP adequacy for each jurisdiction in the county or regional agency, please contact your local assistance staff representative at (916) 341-6199. Section 7.0—Summary of FindingsProvide an overview describing the outcome of the CIWMP or RAIWMP review. Consider including the following information in the overview:
Note: When determining planning document adequacy, please keep in mind that planning document information can be updated through existing reporting processes, such as Annual Reports, corrected or new SWGS (base-year generation study), Time Extension (Plan of Correction), etc. For example, changes in demographics may be addressed with respect to diversion rate measurement via the adjustment method, a corrected or new SWGS or a generation-based calculation. Similarly, adjustments in program implementation resulting from demographic changes should be updated via the Annual Report process. A useful resource with respect to determining the adequacy of each of the planning documents is CIWMP Enforcement Part 1: Plan Adequacy. This policy document addresses content adequacy requirements of each element and plan, regulatory and statutory requirements, the submittal process, the evaluation process by local assistance staff, the approval and disapproval process and proposed methods to correct deficiencies. Section 8.0—Revision ScheduleIf the county or regional agency determines that a revision to one or more of the planning documents is not necessary at this time, no revision schedule is necessary. If it is determined that a revision is necessary, a revision schedule for each planning document to be revised must be provided. The requirements to amend and submit a jurisdiction’s SRRE, HHWE, or NDFE are provided in Title 14, CCR sections 18765 through 18768. Similarly, the requirements for amending and submitting the SE and SP are detailed in Title 14, CCR sections 18780 through 18784. Section 9.0—Supplementary InformationProvide any additional information used in the Five-Year CIWMP or RAIWMP Review. |
