Introduction
State agencies and large State facilities have waste diversion and
disposal reporting
responsibilities resulting from the passage of Chapter 764, Statutes of 1999
(Strom-Martin, AB 75). These requirements largely mirror what is required for cities, counties,
and regional agencies , but do not affect local government obligations under the
California Integrated Waste
Management Act (AB 939, Sher, Chapter 1095, Statutes of 1989 as amended [IWMA]). State agencies and large State facilities must adopt
integrated waste management plans, implement programs to reduce waste
disposal, and have their waste diversion performance annually reviewed by the
California Integrated Waste Management Board (Board).
- "State Agency" means every office, department, division, board,
commission, or other agency of the State of California, including the California Community Colleges and
the California State University. The Regents of the University of California are
encouraged to implement this division.
- "Large State Facility" means campuses of the California State University and
the California Community Colleges, prisons within the Department of Corrections,
facilities of the State Department of Transportation, and facilities of other State
agencies that the Board determines are primary campuses, prisons, or facilities.
Waste Diversion Requirements for State Agencies and Large
State Facilities
State agencies and large State facilities are
required to:
- Divert at least 25 percent of their solid waste from landfills or
transformation facilities
by January 1, 2002, and to divert at least 50 percent by January 1, 2004, through source reduction,
recycling, and
composting activities.
- Designate at least one solid waste reduction and recycling coordinator to oversee
integrated waste management plan
implementation.
- Beginning April 1, 2002, submit an annual report on prior year disposal
and diversion amounts and activities.
The Board is required to:
- Develop and adopt a model State agency integrated
waste management plan for source reduction, recycling, and composting activities.
- Provide technical assistance to State agencies and large State facilities for the
purpose of implementing the integrated waste management plan.
- Develop and adopt standards regarding adequate space for collecting, storing, and
loading recyclable materials in State buildings.
- Complete its review of State agency integrated waste management plans by January 1,
2001.
- Establish and implement a waste reduction award program for State agencies and large
State facilities that develop, adopt, and implement innovative and effective integrated
waste management plans.
The Board may:
- Establish an alternative to the 50 percent diversion requirement for State agencies and
large State facilities that meet specified criteria.
- Adopt regulations that establish criteria for granting, reviewing, and considering
reductions or extensions.
- Determine at a public hearing, on or after January 1, 2002, whether to grant alternative
requirements or whether to require the State agency or large State facility to resubmit
its notification within a certain time period.
- Determine at a public hearing whether to grant one or more single or multiyear time
extensions or whether to require State agency or large State facility to resubmit its
notification within a certain time period.
