Dear Annual Report Filer: In September 2007, CIWMB informed you that the planning document and program review sections of the 2006 Electronic Annual Report (EAR) were ready for use. The CIWMB could not release the online diversion rate calculator then because complete 2006 taxable sales data was not available. These are important factors used in the diversion rate calculation. The September notice contained each jurisdiction’s unique 10-digit password, and encouraged you to begin working on the planning document, diversion program and large venues and events sections of your 2006 EAR. Many jurisdictions have taken advantage of this opportunity. All 2006 diversion rate calculation factors, and the on-line calculator itself, are now available. Therefore, all jurisdictions--whether or not they use the adjustment method to calculate their diversion rate--should now complete and file their 2006 EAR. The following is the web address for the EAR: https://secure.ciwmb.ca.gov/juris/ear/login.asp The due date for submitting your 2006 CIWMB Annual Report is Saturday, March 15, 2008. Jurisdiction Diversion Programs and DetailsPlease take time to update your diversion program notes for the key programs in your jurisdiction. The program implementation information is a critical component of CIWMB staff’s review to assess your compliance with the AB939 diversion requirements. For jurisdictions that have not met the diversion requirement in 2006, we strongly encourage you to include information in Section C of the EAR. Please submit information in this section to describe how your jurisdiction is making a good faith effort and has made all reasonable and feasible efforts to meet the requirements. For information on the types of information that jurisdictions might provide the Board to substantiate a good faith effort determination, please see Public Resources Code Section 41825. Updating Data for Large Venues and EventsEnacted legislation (AB 2176, Montanez, Chapter 879, Statutes of 2004) requires jurisdictions to collect specific data about solid waste diversion efforts at large venues and events and report it to the CIWMB in their annual report. As a result, the 2005 EAR marked the onset of reporting waste diversion efforts at large venues and events within a jurisdiction's boundaries. In the 2006 EAR, jurisdictions should review their venue and events data from 2005 and update it and/or add any new large venues and events. The 2006 EAR is designed to allow jurisdictions to easily review their 2005 large venues and events data, copy it into the 2006 EAR and update it.
