Implementation Timeline Electronic Waste Recycling Act of 2003

California has enacted landmark legislation establishing a funding system for the collection and recycling of certain electronic wastes.

The Electronic Waste Recycling Act of 2003 , as amended, requires the California Integrated Waste management Board (CIWMB) and the Department of Toxic Substances Control (DTSC), in coordination with a range of stakeholders, to implement the various aspects of the law within specified timeframes.

Below is a timeline showing key milestone dates as currently defined by statute and regulation. Note that dates may change if laws are amended. Please refer to the legislation and regulation for complete information.

2004
January 1	After this date, jurisdictions must identify e-waste management activities in any revision to their Household Hazardous Waste Elements (HHWE).
April 1	Manufacturers shall inform retailers of products sold that are covered by the act.
July 1	Unlawful to sell covered electronic device unless manufacturer is in compliance with act.
July 1	CIWMB/DTSC to establish electronic waste recovery and recycling payment schedule.
2005
January 1	Collection and recycling activities for which payment will be claimed may begin. Retailers begin collection of electronic waste recycling fee on sales of covered electronic devices. Sale of unlabeled devices prohibited.
July 1	Manufacturers submit reports to CIWMB detailing (1) number of covered devices sold in California and (2) amount of specified materials contained in products.
July 1	CIWMB/DTSC review and adjust, as necessary, the electronic waste recycling fee.
July 1	Manufacturers must make electronic waste management information available to consumers.
July 1	State agencies to establish environmental purchasing criteria for certain electronic products.
December 5	Emergency regulations revised.
2006
July 1	CIWMB/DTSC to reestablish electronic waste recovery and recycling payment schedule.
July 1	CIWMB adopted final regulations.
August 1	CIWMB/DTSC to review adequacy of electronic waste recycling fee level.
November	Final regulations take effect.
2007
January 1	DTSC regulations forbidding sale of devices containing materials prohibited by EU Directive 2002/95/EC may become effective.
December 31	Targeted date by which to eliminate electronic waste stockpiles and legacy devices.
