Questions and Answers

The following questions were received by California Integrated Waste Management Board (CIWMB) program staff in response to the Waste Tire Public Education and Amnesty Grant Program (Amnesty Day) Application. In addition to posting here, the questions and answers were mailed to everyone who requested a copy by checking a box on the Notice of Funds Available.

Q1. The application instructions indicate an application for two or three jurisdictions must include either (1) a JPA agreement and letter, or (2) a MOU from the non-lead agencies. The tire grants used to allow just a letter from a city manager/administrator, and the HHW and UMO grants still allow just a letter. JPAs and MOUs are more complicated and get attorneys involved, thereby increasing the cost of applying for a grant. To be clear, will you accept just a letter from a participating (non-lead) agency in order to qualify for a regional/cooperative project, and therefore, the increased funding allowed for two or three jurisdictions?

A1. Yes, as an alternative to a Joint Powers Agreement (JPA) or Memorandum of Understanding (MOU), a participating (non-lead) jurisdiction may submit a letter of authorization. The letter must be signed by a city manager, a county administrator, or an individual in an equivalent capacity. The letter need only state that the participating agency authorizes the lead agency (specifically named) to act on their behalf as both applicant and grant administrator for this grant.

Q2. a) My supervisor and I have been reading over the amnesty grant packet and have some questions. Must the funds be used strictly for an "event?" We were tossing around ideas like sending out coupons in the mail redeemable for free disposal and/or incorporating waste tire collection from residences into the city's bulky waste pickup program. Both of these would require developing pub Ed materials, etc. They are amnesty but not an event.

b) Does the "amnesty day" have to be one day or could if be several days over a week or so?

A2. The definition of an amnesty event is a day, or series of days set aside to collect residential nuisance waste tires. Besides having a one-day event, this includes sending the community coupons and/or developing a waste tire collection event through a bulky waste pickup program. The duration of events may vary among different jurisdictions. See Appendix D of the Application Information and Instructions Section--Amnesty Day Tip Sheet.

Q3. Also, in the packet there is a form asking us to list prior CIWMB grants. Should we include all grants received by the City of Oakland, or just the grants received by our agency (Community and Economic Development Agency)?

A3. The jurisdiction that is eligible to apply for the funding must provide information on all grants received from the CIWMB in the last three fiscal years (2000/2001, 2001/2002, and 2002/2003). We assume that the Community and Economic Development Agency is not eligible to apply, and is applying for this grant as part of the City of Oakland. If this is the case, the Amnesty Day Grant requires listing of all prior CIWMB grants received by the City of Oakland. Eligible applicants for this grant include California cities, counties, special districts or political subdivisions thereof, and qualifying California Indian tribes. If the jurisdiction submitting the application is part of a JPA or MOU, grant information must be included for each entity that is part of the agreement. Listing other grants within the CIWMB provides an internal cross reference. You may search all grants awarded to a specific entity by going to our grants database web site.

Q4. Several cities in the county are in the process of applying for the grant and we would like to approach them to join the county in preparing a joint application. If they decide not to join the county, could we still, independently, apply for the grant? Please define "jurisdiction" as it relates to this grant.

A4. A city or county may apply independently.
Jurisdiction: for the purposes of this application, jurisdiction means California cities, counties, special districts or political subdivisions thereof, and qualifying California Indian tribes. (See Appendix E page 12).
