New Requirements Adopted in the Construction, Demolition and Inert Debris Processing Regulations and Their Possible Application to the Regulation of Other Solid Wastes

Description
At its April 9, 2003 special meeting the Board adopted tiered regulations for Construction, Demolition, and Inert Debris Processing. These regulations, which became effective on August 9, 2003, contain several unique requirements (i.e., they are applied differently than in other Board regulation packages). At its July 7, 2003 meeting the Board's Permitting and Enforcement Committee directed staff to solicit stakeholder feedback on the possible application of these requirements to the regulation of other solid wastes.

Status
Board staff conducted a two-part, two-day workshop on September 22, 2003 and October 30, 2003. See Stakeholder Input below for additional information.

At the January 13, 2004, Board meeting staff presented an analysis of stakeholder feedback. The Board directed staff to begin rulemaking proceedings to move two requirements (surprise random inspections and public hearing) from the Construction and Demolition regulations to the Local Enforcement Agency duties and responsibilities regulations, and to apply two requirements (three strikes and fire prevention plan) to the regulation of other solid wastes. Surprise random inspections and public hearing requirements are part of the Permit Implementation Regulations (AB 1497) rulemaking. Three strikes and fire prevention plan requirements will be part of future rulemakings.
