Current Status
The rulemaking has been postponed to await potential statutory changes on conversion technologies.

Rulemaking History

At its February 19, 2002, meeting, the Board directed staff to initiate a rulemaking to revise the transfer/processing operations and facilities regulatory requirements to address conversion technologies.

A focus group met in March 2003 to receive informal comment and staff revised the draft regulations in May in response to the input (see stakeholder input, below for more detail).

A public workshop was held in August 2003 to get additional informal comment (see stakeholder input, below for more detail).

An agenda item was presented to the Permitting and Enforcement Committee on November 3, 2003, to discuss and request direction on noticing the proposed regulations for a 45-day public review and comment period. The Committee directed staff to initiate a 45-day public comment period with the understanding that staff look at the results of the conversion technology studies (pursuant to AB 2770, Statutes of 2002) and report back to the Committee if any issues required further discussion.

The 45-day public comment period ran from October 22 through December 6, 2004. The notice of proposed rulemaking is published in the California Regulatory Notice Register (October 22, 2004 publication date). The comment period closed at 5:00 p.m. on December 6, 2004.

An agenda item was presented to the Permitting and Enforcement Committee on December 6, 2004, to discuss the proposed regulations and hold a public hearing to allow oral and written comments to be submitted as part of the 45-day public comment period.

Board staff assembled a focus group in March 2003 to receive informal comment on the proposed Conversion Technology Regulations.
