Temporary Solid Waste Facilities Permits

On March 10, 2008, the Office of Administrative Law (OAL) approved the emergency regulations, and the regulations became immediately effective.

Description

Establishment of emergency regulations, as mandated by Public Resources Code Section 44002.1 (added by chaptered bill AB 1473 on October 12, 2007), to authorize an enforcement agency, upon the Board’s concurrence, to issue a temporary solid waste facilities permit to a person operating a solid waste transfer or processing station or a composting facility for which a permit is required but has not been obtained.

California Code of Regulations, Title 14, Division 7, Chapter 5, Article 3.1.1.

Status

In accordance with Public Resources Code section 44002.1, these emergency regulations will be effective until July 1, 2010, and on that date shall become inoperative. The Board will not conduct a permanent rulemaking for this regulation package.
