Active Disposal Site Gas Monitoring and Control

On August 21, 2007, the Office of Administrative Law (OAL) approved the regulations. The regulations became effective on September 20, 2007. A frequently asked questions (Adobe PDF, 202 KB) page has been created to help answer questions about complying with these regulations.

Description
Revision of existing landfill gas monitoring and control regulations for active disposal sites to include the more detailed gas monitoring and control regulations currently applicable to closed disposal sites.

Rulemaking History
On September 19, 2005, Board staff conducted a workshop in Sacramento to solicit comment on informal draft regulation text. A teleconferencing location was available at the Board's Long Beach field office. An audio recording of the workshop is available (See Stakeholder Input above for more information).

At its December 5, 2005, meeting the Board's Permitting and Enforcement Committee directed staff to initiate a 45-day public comment period for the proposed regulations. A 45-day public comment period for proposed text ran from September 15, 2006 through October 30, 2006. Board staff conducted a public hearing on December 4, 2006.

At its February 5, 2007, meeting the Board's Permitting and Compliance Committee directed staff to make changes to the proposed text and to circulate it for an additional 15-day comment period. The comment period ran from February 22 through March 9, 2007. The Board adopted the proposed regulations at its April 19, 2007, meeting.
