Recycling Market Development Zone Loan Program

Description
The revisions to the following sections will implement the Board's use of RMDZ Subaccount funds under Public Resources Code (PRC) Sections 42023.6 and 42024 for leveraging purposes and to participate in various leveraging options, including the State Small Business Loan Guarantee Program (SBLGP); and make minor technical changes to the Recycling Market Development Zone Low-Interest Revolving Loan Fund regulations.

Rulemaking History
At its October 31, 2003 meeting (item 16), the Board authorized staff to begin the process of revising the Loan Program regulations.

Staff conducted an informal workshop at the ZoneWorks workshop for Recycling Market Development Zone Administrators (ZA) on October 30, 2003 in Santa Rosa. This workshop was held to solicit informal comments from Zone Administrators (see stakeholder input, above).

The Office of Administrative Law published the regulations on May 28, 2004 to begin a 45-day public review period, which ended on July 12, 2004.

The 45-day review period ended on July 12, 2004. Board staff is currently preparing responses to comments received by the California Association of Recycling Market Development Zone Administrators.

At its meeting on December 9, 2004, the Board's Sustainability and Market Development Committee authorized an additional 15-day public comment period, which ended Tuesday, January 4, 2005.

The Board’s Sustainability and Market Development Committee approved the revised regulations on January 11, 2005 and sent them to the full Board for adoption.

The Board adopted the revised regulations at its January 18-19, 2005 meeting, and directed staff to submit a final regulatory package to the State Office of Administrative Law.

Board staff submitted a final regulatory package to the Office of Administrative Law (OAL) on March 16, 2005. OAL disapproved the revised regulations on May 4, 2005. Board staff is currently developing a response to OAL’s action, which will be submitted to OAL within 120 days.

The Board resubmitted the regulations to OAL in September 2005. OAL approved the regulations and then filed them with the Secretary of State on October 18, 2005. The regulations will be become effective on November 17, 2005.

Comments from the California Association of Recycling Market Development Zone Administrators were received during the official 45-day public review period that ended July 12, 2004.
