Rulemaking History
Board staff conducted a workshop on November 7,
2003, in Sacramento, to solicit comment on informal draft regulation
text. At its
April
14, 2004 meeting, the Board directed staff to initiate a 45-day public
comment period. A 45-day public comment period ran from November 5 through December
22, 2004.
The Board held a
public hearing on the proposed regulations on January 10, 2005.
After considering comments received during the 45-day comment period and
comments made at the public hearing, Board staff modified the proposed
regulations. Board staff was directed to initiate an additional 15-day
comment period for the proposed changes to the regulations at the
Permitting and Enforcement Committee meeting on March 7, 2005.
A 15-day comment period on the revised proposed regulations extended
from April 7 through 5:00 p.m. on April 22, 2005.
The Board adopted the regulations at its
June
14, 2005, meeting.
On November 17, 2005, the Office of Administrative Law approved the
regulations. The regulations are effective on December 17, 2005.
