On May 18, 2004 the Office of Administrative Law approved the
regulations and filed them with the Secretary of State. The regulations
are effective as of June 17, 2004. Description

Rulemaking History
At its April
7, 2002 meeting the Board's Permitting and Enforcement Committee
directed staff to initiate a 45-day public comment period for the
proposed regulations.
A 45-day comment period ran from September 12 through October 27, 2003.
The Board conducted a public hearing at the
November 3, 2003 Permitting and Enforcement Committee meeting.
The Board adopted the regulations at its
February 18,
2004 meeting.
Staff submitted the final rulemaking file to the Office of Administrative Law
on April 6, 2004.
