Alternative Daily Cover

On May 24, 2004 the Office of Administrative Law approved the regulations and filed them with the Secretary of State. The regulations are effective as of July 23, 2004.

Description
Revision of existing regulations that control the use of alternative daily cover (ADC) materials at solid waste landfills and the reporting of that use.

Rulemaking History
Board staff conducted workshops on June 26, 2002, in Sacramento, and on July 11, 2002, in Diamond Bar to solicit comment on informal draft regulation text.  At its October 7, 2002 meeting the Permitting and Enforcement Committee directed staff  to begin a 60-day public comment period. The comment period ran from April 18 through June 17, 2003.

Board staff conducted workshops to solicit feedback on the proposed regulations on June 9 in Sacramento, and on June 23, 2003 in Diamond Bar. The Board held a public hearing at the July 7, 2003 Permitting and Enforcement Committee meeting. At its August 4, 2003 meeting the Permitting and Enforcement Committee directed staff to begin an additional 15-day comment period for changes to the regulations. The comment period ran from August 7 through August 22, 2003.

At its September 8, 2003 meeting the Permitting and Enforcement Committee directed staff to begin a second 15-day comment period for changes to the regulations. The comment period ran from September 15 through September 30, 2003.

The Board adopted the regulations at its October 15, 2003 meeting.

Staff submitted the final rulemaking file to the Office of Administrative Law on April 12, 2004.
