Waiver of Permit Terms and Conditions During Temporary Emergencies

 

The Office of Administrative Law approved the regulations on April 4, 2003. The regulations became immediately effective.

Description
Establishment of a process for facility operators to request approval to operate outside of the limits and terms and conditions of the solid waste facilities permit in the event of an unforeseeable situation.

Rulemaking History
The Board conducted a public workshop on August 7, 2001, to discuss draft emergency regulations. At its August 14-15, 2001, meeting the Board adopted emergency regulations with minor changes to be made prior to submittal to the OAL. Staff submitted an emergency regulation package to OAL on October 30, 2001, for a 10 calendar day review. The Office of Administrative Law approved emergency regulations on November 1, 2001; the regulations became immediately effective.

Board staff conducted a public workshop on December 14, 2001, to solicit input on the permanent regulations. At its January 22-23, 2002, meeting the Board directed staff to begin the formal rulemaking process for the permanent regulations by publishing a notice for a 45-day comment period. The comment period ran from August 30 through October 15, 2002. The Board conducted a public hearing at the November 12, 2002 Permitting and Enforcement Committee meeting.

The Board adopted the regulations at its December 10, 2002 meeting. The Office of Administrative Law approved the regulations on April 4, 2003.  The regulations became immediately effective.
