CEQA Panel:  Roles and Responsibilities

Interest Based Conflict Management Process from LEA/CIWMB Conference 1999: "CEQA Roles and Responsibilities"

Panel Members:
Planner - Bruce Smith, LEA -  Bill Stratton, LEA - Lynn Johnson, LEA - Ernie Genter, CIWMB - Marcia Kiesse, CIWMB Legal - Elliot Block

Raise Issues - Level of CIWMB oversight, timing (CIWMB should get involved early in the process), lack of coordination among involved parties, role clarifications, balanced evaluations, unclear expectations, inefficiency (duplication of efforts) are all issues that were agreed to be problems that may hinder the process.

Issue Statement - "The current implementation of the CEQA process does not always invite coordination."

Shared Interests - Efficient use of time and resources, understanding each role and responsibility and their authority, and the expectations of the roles, credibility with governing bodies and communities, minimize litigation, understanding thresholds of significance and specificity of supporting information, focus on outcome of compliant facilities, to have an adequate CEQA document, mutual respect among colleagues/partners, and fostering early, open,clear and frequent communication.

Options Generated - CIWMB share information (CEQA issues/experience), establish a single liaison at the state level to increase communication and local involvement, establish specialized CEQA guidelines including: thresholds of significance, environmental analysis methodology, procedures and time frames, mitigation measures, minimum project description, models, conference, training or implementation plans with neutral CEQA facilitator to define and clarify roles, processes and clarify vague issues with an MOU.

Agreement - Identify communication tools that are and are not working, define significance thresholds, agreement timelines and responsible parties, agree on budget requirements, define CEQA roles and activities, define expectations, provide everything in writing, component to evaluate agreement (to include measurable outcomes), complete agreement and prioritize activities, focus on short-term activities, use CIWMB website to accomplish goals, include CCDEH-SWPC and CIWMB Permitting and Enforcement or others, revive Partnership 2000 meetings, tap into other third party CEQA workshops.
