Biennial Review Status Definitions |

The biennial review is the Boards evaluation of a jurisdictions progress in implementing waste diversion and reduction programs to meet the requirements of 25 percent diversion in goal year 1995 and 50 percent diversion in goal year 2000 and beyond. As a result of the biennial review, the Board may either: find that the jurisdiction has implemented programs and achieved the diversion requirements; find that the jurisdiction has made a "good faith effort" (see Public Resources Code Section 41850 (c)(1)(B)) toward program implementation and diversion; or initiate a compliance process for jurisdictions failing to implement waste diversion programs and/or failing to achieve the diversion requirement. Status codes represent the Board's actions when reviewing a jurisdiction's progress during the biennial review. Please note that in some instances a jurisdiction may not have a diversion rate for a report year and yet may have a status code of Board approved or accepted for the biennial review. In some instances, diversion rates cannot be accurately determined for a report year due to inaccurate base-year data, a Board approved/accepted base year that is later than the report year, or other issues. Board Approved: The Board has determined that a jurisdiction has implemented programs and met the diversion requirements in a goal year. Board Approved with New Base Year: The Board has determined that a jurisdiction has implemented programs and met the diversion requirements. The jurisdiction's diversion rate is based on a new base-year generation study approved during the biennial review. Board Approved Good Faith Effort: The Board has determined that the jurisdiction has made a "good faith effort" to implement its waste diversion and reduction programs to meet the diversion requirements. Board Approved Good Faith Effort with New Base Year: The Board has determined that the jurisdiction has made a "good faith effort" to implement its waste diversion and reduction programs to meet the diversion requirements. The jurisdiction's diversion rate is based on a new base-year generation study approved during the biennial review.Board Accepted: The Board has evaluated a jurisdiction's progress in meeting the diversion requirement in a non-goal year and accepted its progress. Board Accepted with New Base Year: The Board has evaluated a jurisdiction's progress in meeting the diversion requirement in a non-goal year and accepted its progress. In addition, the Board has approved a new base-year generation study for that year.Board Approved Time Extension: The board has granted a time extension to the jurisdiction to meet the mandated diversion requirements.
Board Approved Alternative Diversion Requirement: The board has granted an alternative diversion rate requirement to the jurisdiction for meeting the mandated diversion requirement.
Board Approved Time Extension Biennial Review Delayed: Biennial review is delayed for the report year because the jurisdiction is continuing a time extension previously granted by the Board. Board Approved Alternative Diversion Requirement Biennial Review Delayed: Biennial Review is delayed for the report year because the jurisdiction is continuing an alternative diversion requirement previously granted by the Board. Board Approved Reduced Diversion Requirement: The board has reduced the diversion requirement for a jurisdiction because meeting the requirements is not feasible due to the small geographic size and/or low population density of a rural jurisdiction and/or the small quantity of solid waste generated within the jurisdiction.Compliance Active: The Board has initiated a compliance process because a jurisdiction failed to implement waste diversion programs and/or failed to achieve the diversion requirement. A compliance order contains a time schedule which is intended to focus the jurisdiction's efforts on a plan of action to implement its waste diversion programs and/or achieve the diversion requirement. Compliance Fulfilled: The Board has determined that a jurisdiction under compliance has fulfilled the requirements for a compliance order and no further action needs to be taken.Board Approved, Compliance Fulfilled: The Board has determined that a jurisdiction under compliance has fulfilled the requirements for a compliance order. In addition, the Board has determined that the jurisdiction has implemented programs and met the diversion rate requirements. Board Approved, Good Faith Effort, Compliance Fulfilled: The Board has determined that a jurisdiction under compliance has fulfilled the requirements for a compliance order. In addition, the Board has determined that the jurisdiction made a "good faith effort" to implement its waste diversion and reduction programs to meet the diversion rate requirements.Preliminary Data Under Staff Review: The Board has not yet completed the biennial review of a jurisdiction.
