Waste Classification Rule Training

March-May 2002
Four locations throughout California

In 2002, the California Integrated Waste Management Board (CIWMB) offered a training course on the classification of waste under federal and state laws. Waste is subject to different regulatory requirements depending upon its status as hazardous, designated, solid or inert. This class was part of our LEA training program's continuing efforts to offer training on solid waste issues to the Board’s designated local enforcement agencies (LEA) and other interested parties.

Waste Classification

Waste classification and load checking are interrelated. Load checking utilizes a solid waste operator’s best efforts to identify and prevent hazardous and other prohibited wastes from entering the solid waste stream. Waste classification laws, regulations and programs define which wastes can be accepted at a solid waste facility and which must be excluded.

Goals of the Workshop

• Review relevant provisions of the federal Resource Conservation Recovery Act (RCRA)
• Review relevant provisions of California statute and regulations
• Clarify the differences in state and federal law and regulations
• Review the criteria used by United State Environmental Protection Agency (US EPA) and Department of Toxic Substance Control (DTSC) to classify waste as hazardous waste
• Review the criteria used by State Water Resource Control Board (SWRCB) and Regional Water Quality Control Boards (RWQCB) to classify waste as designated waste, nonhazardous solid or inert waste
• Describe the requirement to treat, store and dispose of each waste type
• Learn how waste classification affects waste management decisions at solid waste facilities
• Identify sources of information and staff resources

Summary

Ninety-one (91) people attended the training including representatives of solid waste facilities, LEAs, CIWMB, DTSC, and SWRCB/RWQCBs. Attendees were offered 5 hours of CEU credits for this workshop from the Solid Waste Association of North America (SWANA).

Jon Marshack initially developed the curriculum and taught this class to SWRCB and RWQCB staff. At the invitation of CIWMB, Jon Marshack and Corey Yep (DTSC) adapted the class for LEAs.
