Definitions of Terms

Scoped: Board staff, in cooperation with interested parties, identifies issues, objectives, tasks, strategy, timing, staff assignments, etc.

Draft Developed: Board staff drafts regulation text for informal review and comment.

Input Gathered: Board staff solicits comments from interested parties through public workshops, focused workgroups, general mailings, etc.

45-day Direction: Board staff seeks direction from the Board or Permitting and Enforcement Committee to begin the formal rulemaking process by publishing a notice for a 45-day comment period with the Office of Administrative Law.

Note: Prior to publication of this notice staff must complete an Economic and Fiscal Impact Statement, an Initial Statement of Reasons, and a Notice of Proposed Rulemaking.  The Cal/EPA Secretary must approve the Economic and Fiscal Impact Statement.  These tasks can take 60 days or more to complete.

Notice: Office of Administrative Law publishes a Notice of Proposed Rulemaking in the California Regulatory Notice Register. Board staff mail notices to interested parties. Initiates formal rulemaking process, 45-day comment period, and one-year timeline to submit completed rulemaking file to the Office of Administrative Law.

Public Hearing: Public hearing held at a Board or Permitting and Enforcement Committee meeting to permit oral and written comments.

15-day Direction(s): Board staff seeks direction from the Board or Permitting and Enforcement Committee to begin an additional 15-day comment period for changes made to the regulation text. Can be multiple 15-day comment periods.

Board Adoption: Board considers adopting the regulations. Regulations are not effective until the Office of Administrative Law approves and files with the Secretary of State.

OAL Final Approval: Office of Administrative Law has 30 working days to review and approve the regulations. Upon approval, the Office of Administrative Law will file regulations with the Secretary of State.

Effective Date: Typically 30 days from date regulations filed with Secretary of State but the Board can request an alternate effective date that is less than or greater than 30 days.
