Permitting of Solid Waste Facilities

The Board's Permit Program reviews solid waste facilities permits submitted by local enforcement agencies (LEA) and recommends for or against concurrence in the permit to the Board. Permits include design, operational, financial, and closure/postclosure requirements. The Permit Toolbox provides resources for obtaining, revising, and maintaining a solid waste facility permit.

The processing of solid waste facility permits is administered by the Board's Permitting and Local Enforcement Agency Support Division in conjunction with Local Enforcement Agencies.

Although a solid waste facility permit can be processed concurrent with, or prior to, other required permits, facility operations might be delayed without obtaining other local, State, or federal permits or approvals.

Until 1996, virtually all solid waste handling activities were subject to the requirement of first obtaining a "full" solid waste facility permit or an exemption from the requirement of obtaining this permit from the LEA with jurisdiction over the proposed site.

The Board has since implemented regulations that exclude some activities from permitting requirements, allow others to operate after making a notification to the LEA, and many others to operate with less burdensome forms of a permit. Some activities still require the full solid waste facility permit.
