Resolution Examples: CIWMB Grants

For applicants subject to a governing body, e.g., City Council, Board of Directors, the grant application requires an approved resolution, dated and attested to/certified by the person authorized to verify resolutions.

The following example resolutions provide authorization language for:

All CIWMB Grants

WHEREAS, Public Resources Code sections 40000 et seq. authorize the California Integrated Waste Management Board (CIWMB) to administer various Grant Programs in furtherance of the State of California’s (State) efforts to reduce, recycle and reuse solid waste generated in the State thereby preserving landfill capacity and protecting public health and safety and the environment; and

WHEREAS, in furtherance of this authority the CIWMB is required to establish procedures governing the application, awarding, and management of the grants; and

WHEREAS, Grant Application procedures require an Applicant’s governing body to authorize by resolution its approval for submittal of the Grant Application(s) identified below, and the designation by job title of the individual authorized to execute all Grant documents on behalf of (Name of Applicant); and/p>

WHEREAS, if awarded, (Name of Applicant) will enter into a Grant Agreement with the CIWMB for implementation of said Grant(s).

NOW, THEREFORE, BE IT RESOLVED that the (Title of Governing Body) authorizes the submittal of application(s) to the CIWMB for all grants for which (Name of Applicant) is eligible;

BE IT FURTHER RESOLVED that this authorization is effective for (Insert Time Period: from Month, Day, Year through Month, Day, Year); time period not to exceed five (5) years from date of adoption;

BE IT FURTHER RESOLVED that the (Job Title), or his/her designee is hereby authorized and empowered to execute in the name of the (Name of Applicant) all grant documents, including but not limited to, applications, agreements, amendments and requests for payment, necessary to secure grant funds and implement the approved grant project.

Specifically Identified CIWMB Grants

BE IT FURTHER RESOLVED that this authorization is effective for (Insert Time Period: from Month, Day, Year through Month, Day, Year); time period not to exceed five (5) years from date of adoption;

BE IT FURTHER RESOLVED that the (Job Title), or his/her designee is hereby authorized and empowered to execute in the name of the (Name of Applicant) all grant documents, including but not limited to, applications, agreements, amendments and requests for payment, necessary to secure grant funds and implement the approved grant project.

One CIWMB Grant Only

WHEREAS, Grant Application procedures require an Applicant’s governing body to authorize by resolution its approval for submittal of the Grant Application(s) identified below, and the designation by job title of the individual authorized to execute all Grant documents on behalf of (Name of Applicant); and

WHEREAS, if awarded, (Name of Applicant) will enter into a Grant Agreement with the CIWMB for implementation of said Grant.

NOW, THEREFORE, BE IT RESOLVED that the (Title of Governing Body) authorizes the submittal of an application for (Name of Grant);

BE IT FURTHER RESOLVED that this authorization is effective for (Insert Time Period: from Month, Day, Year through Month, Day, Year); time period not to exceed five (5) years from date of adoption;

BE IT FURTHER RESOLVED that the (Job Title), or his/her designee, is hereby authorized and empowered to execute in the name of the (Name of Applicant) all grant documents, including but not limited to, applications, agreements, amendments and requests for payment, necessary to secure grant funds and implement the approved grant project.

Local Public Agencies (Regional Participants in Grant Project)

Local public agencies may join together in a regional grant project. One of the agencies must be identified as the grant applicant/lead agency who, if awarded the grant, is legally responsible for the administration of the grant. All parties to the regional grant project must provide authorizing documentation to the CIWMB evidencing this understanding. The governing body of the grant applicant must adopt a resolution that authorizes submittal of a regional grant application, identifies the applicant as the lead agency and identifies the participants. Each participating local public agency must submit documentation that identifies the applicant as the lead agency and authorizes it to submit the regional grant application on behalf of the grant participant. The following language is presented for sample purposes only. Please consult with your attorney.

Applicant/Lead Agency for a Regional Project

WHEREAS, pursuant to its authority the California Integrated Waste Management Board (CIWMB) offers the (Name of Grant) (Grant); and

WHEREAS, in furtherance of this authority the CIWMB is required to establish necessary procedures governing the application, awarding and management of the Grant; and

WHEREAS, procedures established by the State of California and the CIWMB require each Applicant’s governing body to certify by resolution its approval of submission of a Grant application; and

WHEREAS, if awarded a Grant, the (Name of Applicant) will enter into an Agreement with the CIWMB for implementation of the Grant.

NOW, THEREFORE, BE IT RESOLVED that the (Title of Governing Body) authorizes (Name of Applicant) to submit a (Name of Grant) regional application on behalf of itself and the participating jurisdictions as shown by the attached documentation.

BE IT FURTHER RESOLVED that the (Title of Official), or its designee, is hereby authorized and empowered to execute on behalf of (Name of Applicant) all Grant-related documents, including, but not limited to, Applications, Payment Requests, Agreements, and Amendments necessary to secure Grant funds and to implement and carry out the purposes specified in the Grant Application.

Participant Documentation

Participants must submit one of the following:

  • A resolution from the participant’s governing body that authorizes submittal of a regional grant application on its behalf as a grant participant and designates the applicant as the lead agency for the grant.
  • A letter, signed by an individual who has authority to contractually bind the participating jurisdiction (e.g., the chief administrative officer), that authorizes submittal of the regional grant application, identifies the jurisdiction as a grant participant and designates the applicant as the lead agency for the grant. The letter must be on the participating agency’s letterhead and dated within the 12 months prior to the application date.
  • Joint Powers Authority (JPA): a letter from each JPA member jurisdiction, signed by an individual who has authority to contractually bind the participating jurisdiction (e.g., the chief administrative officer), that authorizes submittal of a regional grant application, identifies the jurisdiction as a grant participant and designates the applicant as the lead agency for the grant. The letter must be on the participating agency’s letterhead and dated within the 12 months prior to the application date.
  • A fully executed Memorandum of Understanding (MOU) between the applicant agency and the participant agency(ies) that authorizes the submittal of a regional grant application, identifies the jurisdictions as grant participants and designates the applicant as the lead agency for the grant.

Participant in a Regional Program

WHEREAS, pursuant to its authority the California Integrated Waste Management Board (CIWMB) offers the (Name of Grant) Grant; and

WHEREAS, in furtherance of this authority the CIWMB is required to establish necessary procedures governing the application, awarding and management of the Grant; and

WHEREAS, procedures established by the CIWMB require for regional grant applications that each participant in the proposed regional grant project formally authorize submittal of the Grant application and identify the Applicant as the Lead Agency for the Grant.

NOW, THEREFORE, BE IT RESOLVED that the (Title of Governing Body) authorizes (Name of Applicant) to submit a (Name of Grant) regional application in which (Name of Participant) is a grant participant.

BE IT FURTHER RESOLVED that the (Name of Applicant) is hereby authorized and empowered to execute all Grant-related documents, including, but not limited to, Applications, Payment Requests, Agreements, and Amendments necessary to secure Grant funds and to implement and carry out the purposes specified in the Grant Application.
