Electronic Product Management California E-Waste Updates:
Dear Electronic Product Stakeholder: This electronic newsletter is an update on the implementation of California`s Electronic Waste Recycling Act of 2003 and other electronic waste (e-waste) management developments in California. ===================== In this issue: PERMANENT REGULATIONS TRANSMITTED TO OAL VERIFICATION OF NET COST REPORTS CEW COLLECTION TIP: DOCUMENTING LARGE TRANSFERS ===================== #### Permanent Regulations Transmitted to OAL #### To implement certain provisions of the Electronic Waste Recycling Act of 2003, the California Integrated Waste Management Board (CIWMB) adopted permanent regulations on July 18, 2006. These regulations primarily apply to the covered electronic waste (CEW) recovery and recycling payment system. The compiled rulemaking package was transmitted to the Office of Administrative Law (OAL) on Friday, October 13, 2006. OAL has 30 days to review the package for completeness before approving the new regulations and the regulations become effective. All participants in the CEW system should take the time to thoroughly review and prepare for the new regulations in advance of their effective date. Key changes from the existing emergency regulations include (but are not limited to): - Enhanced source documentation requirements for CEW transfers of
five or more; Information on the new regulations can be found at: #### Verification of Net Cost Reports #### As reported in the last newsletter, the CIWMB`s contractor, R.W. Beck (in partnership with Humboldt State University), will be contacting a cross section of participants in the CEW recovery and recycling payment system to clarify and/or verify information contained in the Net Cost Reports submitted earlier this year. The CIWMB retained R.W. Beck to assist in the analysis of the Net Cost Reports with the aim of informing the CIWMB about the need for adjustments to the advance recycling fee and/or the standard payment rates for collection and recycling activities. All CEW payment system participants contacted as part of this project are strongly encouraged to fully cooperate. Most of the selected reports will be reviewed for clarification via phone, email or fax communication; however a small number of reports will be selected for verification through on-site review of supporting documentation. The CIWMB will be refining the Net Cost Reporting process with an eye toward improving the quality of data captured, and will once again be offering training on the Net Cost Reporting process via a series of "webinars" in January 2007. Stay tuned for further announcements. More information on Net Cost Reporting requirements is available on
the CIWMB website at: #### CEW Collection Tip: Documenting Large Transfers #### Once the permanent regulations become effective (currently anticipated by mid-November), all collectors in the CEW recovery and recycling payment system will need to conform to new source documentation requirements. Some of the most significant of the new requirements pertain to the clarified tracking of unit counts from each source and enhanced documentation for transfers of five or more units. Specifically, whenever a collector receives a transfer of five or more CEW units discarded by a non-residential source, the collector must record a contact name and phone number as well as the standard name and address of the discarding organization. It is important to note that this requirement also applies to approved collectors that are local governments as well as designated approved collectors. This new requirement can be found in Section 18660.20(j)(1)(C) of the
permanent regulations. Information on the permanent regulations can be
found at: The CIWMB recommends initiating this recordkeeping practice immediately so that both collectors and CEW sources are familiar with this new requirement when the permanent regulations become effective. =================================== Please note that e-mail correspondence with the State of California related to e-waste management in general, and implementation of the Electronic Waste Recycling Act in particular, should be directed to ewaste@calepa.ca.gov.
