This electronic newsletter is an update on the implementation of California`s Electronic Waste Recycling Act of 2003 and other electronic waste (e-waste) management developments in California.

#### CIWMB Adoption of Proposed Final Regulations ####

To implement certain provisions of the Electronic Waste Recycling Act of 2003, the California Integrated Waste Management Board (CIWMB) has adopted permanent regulations that will replace the existing emergency regulations upon approval by the Office of Administrative Law (OAL). These regulations primarily apply to the covered electronic waste (CEW) recovery and recycling payment system.

Following an initial 45-day comment period that closed May 8, 2006, a public hearing held May 9, 2006, and a subsequent 15-day comment opportunity that ended June 23, 2006, the CIWMB’s Sustainability and Market Development Committee considered the revised proposed regulations at its July 11, 2006 meeting. The Committee voted to adopt the regulations and to recommend adoption to the full Board. The full Board subsequently adopted the regulations on consent at its July 18, 2006 meeting.

Program staff will now finalize the rulemaking package for transmittal to OAL. That transmittal should occur in late August or early September. OAL then has 30 days to review the package for completeness before approving the new regulations and the regulations become effective.

The CIWMB will be providing guidance through this newsletter and other media about pending new requirements. However all participants in the CEW system should take the time to thoroughly review and prepare for the new regulations in advance of their effective date.

#### USEPA Establishes New Rules for CRT Management ####

As a courtesy, the CIWMB e-waste program announces that the USEPA has established new rules for the management of cathode ray tubes (CRTs). Information about this development can be found on the USEPA website:

It is important for all handlers and processors of CRTs in California, including approved collectors and recyclers participating in the California covered electronic waste recovery and recycling payment system, to note that California may have more stringent requirements with respect to some aspects of CRT management, while the federal rules may contain more stringent standards in others (such as export issues). Handlers and processors must abide by the more stringent standards where they apply.

#### EPEAT Debuts Product Registry ####

The Electronic Product Environmental Assessment Tool (EPEAT) is a procurement tool to help large volume purchasers in the public and private sectors evaluate, compare, and select desktop computers, notebooks, and monitors based on their environmental attributes. EPEAT also provides a clear and consistent set of performance criteria for the design of products and provides an opportunity for manufacturers to secure market recognition for efforts to reduce the environmental impact of their products.

The CIWMB is working with California’s State and Consumer Services Agency to use EPEAT as guidelines to improve the State’s own consumption of information technology. The CIWMB encourages all institutional consumers to consider using EPEAT as a guide in IT purchasing considerations.

#### CEW System Participants Must Keep Data Current; Re-Apply after Two Years ####

As noted in this space many time, it is imperative that all approved collectors and recyclers keep application information up to date with the CIWMB. Failure to do so can slow down payment processing and even result in revocation of approval. All participants are urged to review their own copy of the application (Form 186) originally sent to the CIWMB and determine if any information requires updating. If so, simply use a copy of the original application, make note what needs to be revised, and send in to the address on the form.

If the revised information requires something more than a simple update, program staff will follow-up with participants and provide direction. Note that it is the responsibility of the participant to initiate updates based on changed conditions.

Also note that an approval in the payment system lasts for two years. Some of the original participants are coming up on their two-year renewal window. As a result of the newly adopted permanent regulations, the standard application form will likely undergo some minor modifications. However applicants who wish to renew now will not be required to reapply under a revised form unless or until their two-year term is expiring.
