#### Revisions to Proposed Regulations to Be Heard June 6, 2006; Additional Comment Period Sought ####

To implement certain provisions of the Electronic Waste Recycling Act of 2003, the California Integrated Waste Management Board (CIWMB) has proposed final regulations which primarily apply to the covered electronic waste (CEW) recovery and recycling payment system. The proposed regulations were discussed at the CIWMB's Sustainability and Market Development Committee meeting on February 7, 2006, where direction was given to proceed with formal noticing.

The 45-day comment period closed May 8, 2006, and a public hearing was held May 9, 2006. As a result of comments received, program staff is proposing several revisions to the proposed regulations. These proposed revisions will be heard at the June 6, 2006 meeting of the CIWMB's Sustainability and Market Development Committee.

#### Fee and Payment Rates to Be Considered June 6, 2006; No Adjustment to Rates Proposed ####

The Electronic Waste Recycling Act of 2003 established a financial system to cover the net costs of collecting and recycling covered electronic wastes (CEWs) generated in California.

Public Resources Code (PRC) Section 42464(f) authorizes and requires the California Integrated Waste Management Board (CIWMB) to make adjustments to the Electronic Waste Recycling Fee (Fee) paid by consumers to ensure that there are sufficient revenues in the Electronic Waste Recycling Account to fund the system.

Furthermore, PRC Sections 42477(a) and 42478(a) authorize and require the Board to establish and adjust the electronic waste recovery and recycling payment rates (Payment Rates) for collectors and recyclers who handle and process CEWs generated in this state.

The CIWMB's Sustainability and Market Development Committee will consider the Fee and Payment Rates on June 6, 2006. At this time, program staff is recommending no change to the Fee or Payment Rate. This recommendation is based on the following:

  • The CEW recovery and recycling system established by the Act is currently in a development and growth phase;
  • The annual Net Cost Reports submitted by approved participants indicate that the Payment Rates are, on average, currently sufficient to cover participants' costs;
  • Based on program trends, the Electronic Waste Recovery and Recycling Account is projected to contain sufficient revenue for at least the next year.

#### Reminder: Manufacturer Reports Due July 1, 2006 ####

Existing emergency regulations require manufacturers of covered electronic devices (CEDs) to report to the CIWMB annually regarding the CEDs sold in California. These reports are due on or before July 1st of each year. For more information, please refer to Title 14 of the California Code of Regulations, Section 18660.41

#### Approved Collector/Recycler Information Maintenance Critical ####

It is critical that all approved participants in the CEW recovery and recycling system maintain accurate application information with the CIWMB.

Recent experience with the required annual Net Cost Report revealed that a number of collectors and recyclers have experienced changes in personnel or other organizational status since being approved in the payment system but have failed to report those changes to the CIWMB as required.

Any and all information required through the application must be kept up to date with the CIWMB's CEW program. Certain changes may require re-approval. Failure to maintain accurate participant information may result in revocation of approval.

Please use the applicable portions of Form 186 to report any changes (such as personnel, contact information, location, activities, etc) that would render the original application inaccurate. The application form can be found at:
