#### Net Cost Reporting Guidance and Forms Now Available ####

The California Integrated Waste Management Board (CIWMB) adopted emergency regulations to implement portions of the Electronic Waste Recycling Act of 2003, including the covered electronic waste payment system. In order to properly set the recovery and recycling payments rates, the CIWMB must evaluate the costs incurred by approved participants when conducting collection and recycling activities. An important tool in this evaluation will be the Net Cost Report currently required of all participants.

Emergency regulations (14 CCR 18660.10) require approved collectors and recyclers to maintain records documenting costs and annually to submit a report to the CIWMB on the net costs of collecting and recycling covered electronic wastes (CEWs). The first report is due by March 1, 2006.

To simplify reporting, the CIWMB developed the CEW Net Cost Report Form (Form 220) and the CEW Cost Estimation Worksheets (Form 220a for collectors and dual entities and Form 220b for recyclers and dual entities). The CIWMB also developed a Guide to Net Cost Reporting that provides detailed information for completing this requirement.

#### Temporary Universal Waste Disposal Exemptions to Expire February 8, 2006 ####

After careful consideration of all comments and discussion with stakeholders, the Department of Toxic Substances Control (DTSC) has made the decision to allow the sunset of the February 8, 2006 exemption from universal waste regulation to stand. The temporary exemption allowed universal wastes from households and conditionally exempt small quantity universal waste generators to be disposed in the trash.

There will be no extension of the sunset date for any of the universal waste streams. After February 8, 2006, all universal waste must be managed under California Code of Regulation Chapter 23 section 66273.1 et seq. Standards for Universal Waste Management or as fully regulated hazardous waste.

DTSC`s Universal Waste website will soon be updated to include the information, as well as a link to a Frequently Asked Questions page.
