Program Responsibilities: Waste Compliance and Mitigation Program

Compliance Evaluation and Enforcement Division

The Compliance Evaluation and Enforcement Division is responsible for all compliance and enforcement activities related to solid waste and tire facilities, and illegal tire disposal; compliance activities related to the Board's minimum content programs (newsprint, trash bags and rigid plastic containers); and compliance activities related to local jurisdiction and state agency waste management planning and diversion requirements.

The division is divided into three branches: The Tire Facilities, Operations, and Evaluations Branch, the Municipal Solid Waste (MSW) Facilities, Operations, and Evaluations Branch, and the Jurisdiction and Minimum Content Compliance Branch.

The Tire Facilities, Operations, and Evaluations Branch's primary goal is to reduce and to the extent possible eliminate the potential for waste tire fires and reduce waste tire piles that contribute to the breeding of vectors. Branch staff:

  • Identify illegal tire haulers and illegal storage piles.
  • Ensure waste tire businesses meet the storage, permit and hauler registration standards.
  • Educate businesses and property owners on the regulations to ensure that they meet these minimum standards.

The MSW Facilities, Operations, and Evaluations Branch is responsible for local enforcement agency (LEA) evaluations, and State-mandated inspections and enforcement at solid waste facilities, including inspections and enforcement as the enforcement agency (EA) in jurisdictions where there is no LEA. Branch staff:

  • Certify and evaluate LEAs to ensure local programs are in accordance with State statutes and regulations.
  • Conduct landfill inspections to determine compliance with permit conditions and State minimum standards and to investigate allegations of immediate threats to public health, safety or the environment.
  • Conduct inspections and direct enforcement in EA jurisdictions.
  • Ensure compliance with federal and State waste management laws and regulations.

The Jurisdiction and Minimum Content Compliance Branch is responsible for ensuring compliance with product minimum content requirements and local jurisdiction and State agency diversion requirements. Branch staff:

  • Ensure compliance with the Rigid Plastic Packaging Container, Plastic Trash Bag, and Newsprint laws.
  • Ensure local jurisdiction and State agency compliance with waste management planning and diversion requirements.
